Terms of Service

1. The service

Bidligence is provided by GigaTech Niugini Limited (company no. 1-148489106), trading as Bidligence, whose registered office is at Section 267, Allotment 09, Debona St, Gerehu, Moresby Northwest District, Port Moresby, National Capital District 121, Papua New Guinea ("Bidligence", "we", "us").

Bidligence provides software that helps construction contractors analyse tender documents, prepare bid documents and manage bid pipelines (the "Service"). By creating an account you agree to these terms on behalf of yourself and, where applicable, the organisation you represent.

2. Your content

You retain all rights to documents, data and content you upload or generate. You grant Bidligence a limited licence to store and process that content solely to provide the Service. Content is processed by the third-party machine-learning model providers behind Bidligence Super Intelligence, under terms that prohibit use of your content for model training.

3. Super Intelligence output

Bidligence Super Intelligence is built on generative machine-learning models from third-party providers (Privacy Policy §3), so what it produces is machine-generated. Output is a draft prepared for your review; you are responsible for verifying every statement, figure and document before submission to any procuring entity. Bidligence flags claims it cannot ground in your evidence but does not guarantee accuracy, completeness or compliance with any tender.

Design drawings produced by the Service are design-development drawings for professional review. They are not for construction: every sheet is marked NOT FOR CONSTRUCTION until the sign-off of a registered professional engineer — their name, licence number and the date — is recorded against the drawing set, and recording it is the attestation of the user who records it. Bidligence provides no engineering services and does not review, check or approve any drawing; responsibility for the design and its fitness for construction rests with you and the professional who signs it off.

4. Subscriptions and billing

Plans are billed in advance per workspace through Paddle, our merchant of record, who issues the invoice and collects any tax. Starter is US$399 per month or US$3,990 per year; Pro is US$799 per month or US$7,990 per year; Enterprise is priced by agreement and invoiced separately. Starter and Pro begin with a free trial of 3 days: you give a payment method at checkout, nothing is charged during the trial, and unless you cancel before it ends Paddle charges the plan price automatically when the trial ends and at each renewal after that. The plan and its monthly credits apply from the first day of the trial; cancelling during the trial keeps the plan until the trial ends, then ends it and its credits, and nothing is charged. There is one free trial per customer: an account, workspace or e-mail address that has had one, or a workspace that has subscribed before, is offered the plan without a trial, and a trial started with a payment card, or by a Paddle customer, that has already had one ends at once: the subscription starts that day, the card is charged for the first period, and we tell you in the app and by e-mail. If that card cannot be charged, the subscription is cancelled and nothing is taken. Separately, each new account receives a one-time grant of 500 welcome credits in the first workspace it creates, once the account’s e-mail address is confirmed (signing in with Google confirms it), recorded in that workspace’s credit ledger — once per e-mail inbox — a further workspace, a deleted and re-created account, or another spelling of the same inbox (Gmail dots, a +tag) starts without them. Where several accounts are created from one network on the same day, a grant may be held until we have reviewed it; we then grant it or tell the account why not. Accounts cannot be opened with temporary or disposable e-mail addresses. Welcome credits cover Super Intelligence analysis, the Bid Score and BOQ pricing; generating the bid documents requires a paid plan. Once they are spent, a workspace with no plan can still be set up and hold documents, but cannot run Super Intelligence analysis. You may cancel at any time and access continues to the end of the paid period.

Cancellation and refunds are set out in the Refund & Cancellation Policy, which forms part of these terms.

5. Credits

Super Intelligence work is metered in credits. Every Super Intelligence action — tender analysis, the Bid Score, a BOQ, a market-rate lookup, each generated document, the Submission Guard, the Mock Evaluator — is charged the credits that action actually consumed. Your balance and the credits used this period are shown in Settings → Plan & billing, and every charge is recorded in your workspace's credit ledger, with the model, the tokens and the time — a statement of it is available from support on request.

Design drawings are charged the same way for their Super Intelligence draft. When a drawing run also converts its sheets to DWG through Autodesk, the Autodesk processing time and viewer translation it used are charged too, at Autodesk's published rate, converted to credits at the same rate as Super Intelligence spend and recorded in the same ledger. A drawing run that fails is refunded the Super Intelligence spend it used.

Your plan grants a fixed number of credits at the start of each billing period: 1,500 on Starter, 5,000 on Pro, and an agreed number on Enterprise. Plan credits are for that period and do not carry over — an unused balance is replaced, not added to, when the next period begins, and the expiry is recorded in your workspace's credit ledger.

You can buy additional credits at any time, by amount: any whole amount from US$50 to US$10,000, at US$1 for 2 credits. Purchased credits do not expire while the subscription is active, and they are only drawn on after the period’s plan credits are used up.

How many credits a piece of work costs depends on the size of the tender and the length of what is produced, so the number of bids a plan covers is an estimate, not a guarantee. When a workspace runs out of credits, Super Intelligence actions stop with a message rather than continuing and billing you; everything else — your documents, your bids, your exports — keeps working.

6. The shared rate index (optional, off by default)

Bidligence keeps a cross-customer index of construction prices. Contributing to it is a per-workspace setting that is OFF unless a user with the finance role or higher — finance, technical lead, bid manager or admin — turns it on in Rate Library → "Contribute anonymised rates". Nothing is contributed while it is off.

When it is on, each priced observation records the catalogue item, the country and region, the unit, the price and its currency, the date it was observed, its evidence class (supplier quote, won bid, published price list, uploaded price list or manual entry) and a confidence weight. Inside Bidligence the same row is also tagged with your workspace and — where the price came from a supplier quote, an uploaded price list or an RFQ — with that supplier, the name of the source document and the wording of the line the price was read from, because that is what lets you withdraw or correct it afterwards. Whole documents are never copied into the index.

None of those tags is published. A shared rate joins the periodically recomputed estimate for its item and country — a value, a low/high band, a confidence, a sample count and a count per evidence class. Once at least three customers have contributed for the same item and country, a shared rate may also be shown to them individually and anonymised: the price and currency, the unit, the evidence class, the confidence and the month. Never the exact date, the supplier, the document, your notes, or which customer it came from.

Turning the setting off withdraws both future and past contributions: your observations are marked unshared and the affected countries are recomputed, so any estimate left without qualifying evidence behind it is deleted. Withdrawal cannot recall a figure another customer has already used in a bid they have priced. Deleting the workspace deletes its observations outright.

7. Acceptable use

You will not use the Service to prepare fraudulent bids, to misrepresent your organisation, or to infringe the rights of others. We may suspend accounts that breach these terms.

8. Liability

The Service is provided "as is". To the fullest extent permitted by law, Bidligence's aggregate liability is limited to the fees paid in the twelve months preceding the claim. Bidligence is not liable for the outcome of any tender.

9. Changes

We may update these terms with notice through the Service. Continued use after the effective date constitutes acceptance.

10. Governing law and disputes

These terms, and any dispute or claim arising out of or in connection with them or the Service, are governed by the laws of Papua New Guinea. The courts of Papua New Guinea — the National Court of Papua New Guinea at Port Moresby, National Capital District — have exclusive jurisdiction to settle any such dispute. Nothing in this section removes a right a consumer has under the law of the country where they live.
